Does insurance cover a rental if I was at fault?

Why fault changes the answer

When another driver causes the crash, losing the use of your car is part of the harm done to you, and a replacement vehicle for the repair period is normally part of what your not-at-fault claim covers.

When you caused it, there is no one responsible for your inconvenience. Your collision coverage repairs the car; it does not, on its own, put you in a rental. That comes from a separate optional endorsement — in Ontario, the OPCF 20.

The same logic covers comprehensive claims. Theft, hail, and deer strikes have no at-fault driver at all, so a rental during those repairs also rides on your own loss-of-use coverage.

Find out what you actually have

Pull up your certificate of insurance and look for the OPCF 20, sometimes labelled loss of use or transportation replacement. It will show a few numbers worth reading closely.

  • A daily limit — the most a rental can cost per day before the difference is yours
  • A per-claim maximum, which caps the total no matter how long the repair runs
  • Sometimes a condition that the vehicle be undrivable, or a short waiting period
  • Occasionally a preference for rentals arranged through the insurance company’s rental partners, which usually means direct billing

What the daily limit really buys

A typical daily cap covers a compact or mid-size car in most weeks. It does not always cover an SUV or a pickup, and it rarely survives a holiday week when GTA rental rates spike.

You can rent above the limit and pay the difference. Ask the counter for the total daily rate including taxes and fees before taking the keys — the add-ons are what push a rental past the coverage.

If your endorsement carries a per-claim maximum, get a realistic timeline from your shop early. A repair waiting on a back-ordered part can outlast the coverage, and that is better learned at drop-off than at the counter.

The cheapest rental is the one you never need

If your car is drivable and safe, it does not have to sit at the shop while parts are on order. We order parts first and book the repair for when they arrive, which shrinks the days the vehicle is actually out of service.

That single scheduling decision saves more rental money than any negotiation with an insurance company ever will. It is standard practice here, and it is why you get a written timeline before you hand over the keys.

How the rental actually gets arranged

The smooth version is a three-way handoff: your insurance company authorizes the rental, the shop confirms the start date, and the rental company has a car ready the morning you drop off. When those three do not talk, you pay for days at either end of the repair that nobody covers.

Coverage runs against the repair period, not your convenience. The clock is meant to start when the vehicle goes in for repair, not the day of the crash, and to end when the repair is complete, not when you get around to returning the car.

Return the rental promptly when the work is done. Days after completion are almost always yours, and they are the most common surprise on the final bill.

Keep the paperwork. If your fault percentage is later revised downward, the rental invoice becomes part of what gets recalculated.

Watch the insurance question at the rental counter too. The damage waiver sold there frequently duplicates protection you already have — your own auto policy may extend to a rental, and some credit cards cover rentals paid on the card. Check both before the trip to the counter rather than deciding under fluorescent-light pressure.

If your insurance company has a rental partner, using it usually means direct billing instead of paying and submitting receipts. That is a genuine convenience — and an entirely different thing from being told where to repair your car.

Ask these before you take the keys:

  • What is the total daily rate including taxes, fees, and surcharges
  • What does my OPCF 20 pay per day, and what is the per-claim maximum
  • What class of vehicle does that actually cover in this market this week
  • Does the rental company bill my insurance company directly, or do I pay and submit
  • Does my own auto policy or credit card already cover damage to the rental
  • Who pays for the days if the repair runs longer than the estimate
  • Whether an after-hours return is possible, and what it costs if it is not
  • Whether the agreement carries a kilometre limit you are likely to exceed

If you do not carry loss-of-use coverage

Check your credit card benefits, some of which include rental coverage or discounts, and take an honest look at whether the household’s second car or the TTC can bridge the repair window — plenty of North York repairs get picked up by someone who took the subway to Sheppard West.

Then add the OPCF 20 at your next renewal. It is one of the cheapest lines on an Ontario policy and the one people most often regret skipping.
