Can my insurance company force aftermarket parts on my repair in Ontario?

The rule in Ontario: like kind and quality

Ontario has no law requiring original-manufacturer parts in a collision repair. Your insurance company’s obligation is to restore the vehicle properly, and its estimate may be written with aftermarket or recycled parts of like kind and quality to keep the claim cost down. That is legal, and on older vehicles it is often perfectly reasonable.

It is not the end of the conversation, though. You can ask for OEM parts and pay the price difference yourself, and on newer vehicles, structural components, and anything tied to a safety system, a well-documented OEM request frequently gets approved outright.

When OEM parts matter most

Structural parts, bumper reinforcements, and sensor-bearing panels are engineered to crush, absorb, and trigger exactly as designed — OEM parts preserve that behaviour. Cosmetic bolt-on panels leave more room for judgment, and a good aftermarket fender on a ten-year-old commuter is a defensible choice.

Our position is written into how we work: we prefer OEM parts, and when you or your insurance company pays for OEM, both the part and our installation are covered by our written parts-and-installation warranty. We will also tell you plainly when an alternative part is genuinely equivalent — and when it is not.

How to ask for OEM without a fight

Have your shop write the estimate with OEM part numbers and a short note explaining why they are warranted — safety system, fit, corrosion protection. Insurance companies approve documented OEM requests far more often than they concede phone arguments.
